FAQ

WHAT IS PATENT LICENSING SERVICES?

When a patent is licensed, an agreement is made between the patent owner (or the licensor) and the person or company that wants to use and benefit from the patent (the licensee). It permits the licensee to make or sell the product, design, or technology in the patent.

HOW MUCH CAN YOU MAKE LICENSING A PATENT?

There is an analogy between the way that one can use a house (a form of real property) and the way one can use intellectual property or patent. Firstly, one can live in a house and use it to protect one from the physical environment; similarly one can protect oneself from the competitive environment by operating within one’s own intellectual property rights. Secondly, one can rent out one’s house; similarly one can license ones intellectual property or patent and allow others to use the intellectual property right for a fee. Thirdly, one can sell one’s house; in the same way one can sell an intellectual property or patent right, this is normally called an assignment.

WHY IS PATENT LICENSING IMPORTANT?

Licensing rights provide others with the ability to utilize a patented innovation. As a patent holder, you own the invention and can earn royalties or licensing fees by selling licensing rights to investors or another company. It is possible to grant varying licensing rights to one firm, or several firms.

WHAT IS "INTELLECTUAL PROPERTY"?

Intellectual Property is the term used to describe the products of human ingenuity, which can be owned and dealt with as a form of property because of a body of laws relating to patents, inventions, creations, trademarks, industrial designs, copyrights, plant breeder’s rights and chip protection legislation. These laws give to the owner of the intellectual property the right to stop others from using the invention or other subject matter of the intellectual property without his or her permission.

WHAT ARE THREE 3 THINGS WHICH A LICENSING AGREEMENT ALLOWS?

In a typical licensing agreement, the licensor grants the licensee the right to 1) produce and sell goods, 2) apply a brand name or trademark, or 3) use patented technology owned by the licensor.

WHAT COULD BE INCLUDED IN A PATENT LICENSING AGREEMENT?

A patent license agreement is a contract between a patent owner (licensor) and a licensee that defines the terms under which the licensee may make, sell, and use a patented invention. The agreement also provides how royalties will be paid and when to the patent owner. It could have a Non-disclosure Agreement and or Confidentiality Agreement.

WHAT ARE THE TWO MAIN FORMS OF LICENSING?

Licensing activity comes in two forms: Licensors give licenses to others; licensees receive licenses from others.

WHAT ARE THE ADVANTAGES OF LICENSING?
  1. It costs less than buying and or building an entire company.
  2. You don’t pay for expensive and time-consuming research and development.
  3. You don’t pay development costs upfront; your paid royalties when you start making sales.
  4. You won’t have large losses if the product doesn’t become successful in your market area.
WHAT ARE THE BENEFITS OF LICENSING A PATENT?

By acquiring rights to a patent, a licensee can:

  1. Create new products, services and market opportunities for themselves.
  2. Reduce costs to acquire new technologies, without having to develop their own.
  3. Save time getting a new product to market.
  4. Gain a competitive advantage over rivals, especially if their license is exclusive.
